第1条

適用

  1. 本規約は、Yusuke（以下「運営者」）が提供するAnima（以下「本サービス」）の利用に関する条件を定めるものです。
  2. ユーザーは、本規約に同意した上で本サービスを利用するものとします。
第2条

定義

  1. 「本サービス」: Animaアプリケーションおよび関連するすべての機能
  2. 「ユーザー」: 本サービスを利用するすべての方
  3. 「Anima」: ユーザーが投稿した感情を視覚化した光のパーティクル
  4. 「共鳴」: 2つのAnimaが近接した際に発生するイベント
第3条

アカウント

  1. ユーザーは、正確な情報を登録してアカウントを作成するものとします。
  2. アカウント情報の管理責任はユーザーにあります。
  3. アカウントの第三者への譲渡・貸与は禁止します。
第4条

サービス内容

本サービスでは、以下の機能を提供します。

  1. テキスト入力による感情のAnima化
  2. 地図上でのAnima表示
  3. 近接したAnimaとの共鳴通知
  4. 共鳴履歴の確認
第5条

禁止事項

ユーザーは、以下の行為を行ってはなりません。

  1. 違法行為: 法令に違反する行為
  2. 公序良俗違反: 公序良俗に反する内容の投稿
  3. 権利侵害: 他者の知的財産権、プライバシー権、名誉を侵害する行為
  4. 迷惑行為: 他のユーザーへの嫌がらせ、ストーキング行為
  5. 不正アクセス: サーバーへの不正アクセス、システムの改ざん
  6. 転売・商用利用: 本サービスの転売や無断の商用利用
  7. なりすまし: 他者になりすます行為
  8. 虚偽情報: 虚偽の情報を登録・投稿する行為
第6条

コンテンツ

  1. ユーザーが投稿したテキストから生成されるAnimaの著作権は運営者に帰属します。
  2. 投稿されたテキスト自体は処理後に削除され、保存されません。
  3. 運営者は、サービス改善のためにAnimaのデータを匿名化して分析することがあります。
第7条

サービスの変更・中断・終了

  1. 運営者は、事前の通知なくサービス内容を変更できるものとします。
  2. 以下の場合、サービスを一時中断することがあります。
    • システムの保守・点検
    • 天災、停電等の不可抗力
    • その他運営者が必要と判断した場合
  3. 運営者は、30日前の通知をもってサービスを終了できるものとします。
第8条

免責事項

  1. 現状有姿: 本サービスは「現状有姿」で提供され、特定目的への適合性を保証しません。
  2. 位置情報の精度: 位置情報の精度について保証しません。
  3. 通信障害: 通信環境に起因する不具合について責任を負いません。
  4. ユーザー間のトラブル: ユーザー間で発生したトラブルについて、運営者は責任を負いません。
  5. 損害賠償: 運営者の故意または重過失による場合を除き、損害賠償責任を負いません。

個人情報

個人情報の取り扱いについては、別途定めるプライバシーポリシーに従います。

第10条

アカウントの停止・削除

  1. 運営者は、以下の場合にアカウントを停止または削除できるものとします。
    • 本規約に違反した場合
    • 登録情報に虚偽があった場合
    • その他運営者が不適切と判断した場合
  2. ユーザーは、設定画面からいつでもアカウントを削除できます。
第11条

規約の変更

  1. 運営者は、必要に応じて本規約を変更できるものとします。
  2. 変更後の規約は、アプリ内での告知をもって効力を生じます。
  3. 変更後も本サービスを利用した場合、変更に同意したものとみなします。
第12条

準拠法・管轄裁判所

  1. 本規約は日本法に準拠します。
  2. 本サービスに関する紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Article 1

Application

  1. These Terms govern the use of Anima ("the Service") provided by Yusuke ("Operator").
  2. Users agree to these Terms when using the Service.
Article 2

Definitions

  1. "Service": The Anima application and all related features
  2. "User": Anyone who uses the Service
  3. "Anima": Light particles visualizing emotions posted by Users
  4. "Resonance": Event occurring when two Animas come close together
Article 3

Accounts

  1. Users shall register accurate information when creating an account.
  2. Users are responsible for managing their account information.
  3. Transfer or lending of accounts to third parties is prohibited.
Article 4

Service Description

The Service provides:

  1. Converting text input into Anima
  2. Displaying Animas on a map
  3. Resonance notifications for nearby Animas
  4. Viewing resonance history
Article 5

Prohibited Activities

Users shall not:

  1. Illegal activities: Violate laws or regulations
  2. Public order violations: Post content against public order and morals
  3. Rights infringement: Infringe on intellectual property, privacy, or reputation of others
  4. Harassment: Harass or stalk other users
  5. Unauthorized access: Attempt unauthorized access or system tampering
  6. Commercial exploitation: Resell or commercially exploit the Service without permission
  7. Impersonation: Impersonate others
  8. False information: Register or post false information
Article 6

Content

  1. Copyright of Animas generated from user text belongs to the Operator.
  2. Posted text is deleted after processing and is not stored.
  3. Operator may analyze anonymized Anima data for service improvement.
Article 7

Service Changes, Suspension, Termination

  1. Operator may change the Service without prior notice.
  2. Service may be temporarily suspended for:
    • System maintenance
    • Force majeure (natural disasters, power outages)
    • Other cases deemed necessary by the Operator
  3. Operator may terminate the Service with 30 days' notice.
Article 8

Disclaimer

  1. As-is: The Service is provided "as-is" without warranty of fitness for any particular purpose.
  2. Location accuracy: Location information accuracy is not guaranteed.
  3. Connectivity: Operator is not responsible for issues caused by network conditions.
  4. User disputes: Operator is not responsible for disputes between users.
  5. Damages: Operator is not liable for damages except in cases of willful misconduct or gross negligence.
Article 9

Personal Information

Personal information handling is governed by the separate Privacy Policy.

Article 10

Account Suspension/Deletion

  1. Operator may suspend or delete accounts when:
    • User violates these Terms
    • Registration information is false
    • Operator deems it inappropriate
  2. Users may delete their account anytime from settings.
Article 11

Changes to Terms

  1. Operator may change these Terms as necessary.
  2. Changed Terms take effect upon in-app notification.
  3. Continued use after changes constitutes acceptance.
Article 12

Governing Law and Jurisdiction

  1. These Terms are governed by Japanese law.
  2. Disputes shall be subject to the exclusive jurisdiction of Tokyo District Court as the court of first instance.
